User Responsibility1. Australian Privacy Act 1988 (Cth)
Propscribe complies with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs). Key measures include:
- Open and transparent management (APP 1): This page and our Privacy Policy detail how personal information is handled.
- Anonymity (APP 2): Users may not use the Service anonymously, as authentication is required for billing and access control.
- Collection (APP 3–5): We collect only information necessary to provide the Service and notify users at the time of collection.
- Cross-border disclosure (APP 8): Personal data is transferred to US-based service providers under appropriate contractual safeguards.
- Data quality (APP 10): Users can update their profile information at any time via Settings.
- Security (APP 11): Data is encrypted in transit and at rest. Access is role-restricted.
- Access and correction (APP 12–13): Users may request access to or correction of their personal information by contacting privacy@propscribe.ai.
2. Notifiable Data Breaches (NDB) Scheme
Under the Privacy Amendment (Notifiable Data Breaches) Act 2017, Propscribe is required to notify the Office of the Australian Information Commissioner (OAIC) and affected individuals if a data breach is likely to result in serious harm.
Our breach response plan includes detection, containment, risk assessment, notification, and post-incident review. In the event of a notifiable breach, we will:
- Notify the OAIC as soon as practicable (within 30 days of becoming aware).
- Notify affected individuals with steps they can take to protect themselves.
- Publish a statement on our website if direct notification is not reasonably practicable.
3. New Zealand Privacy Act 2020
New Zealand users are protected by the Privacy Act 2020 (NZ), which sets 13 Information Privacy Principles (IPPs) broadly aligned with Australia's APPs. Notable NZ-specific provisions:
- Mandatory breach notification: We will notify the NZ Privacy Commissioner and affected individuals of notifiable privacy breaches.
- Access requests: NZ users may request access to their personal information under IPP 6. Requests are processed within 20 working days.
- Offshore transfer: Where data is transferred outside New Zealand, we ensure receiving parties have comparable privacy protections.
NZ users may also contact the Office of the Privacy Commissioner at privacy.org.nz.
4. Australian Consumer Law (ACL) — AI Content Disclaimer
The Competition and Consumer Act 2010 (Cth) Schedule 2 (Australian Consumer Law) and the NZ Fair Trading Act 1986 prohibit misleading or deceptive conduct in trade or commerce, including in real estate marketing.
As a real estate professional using Propscribe, you are responsible for:
- Reviewing and verifying all AI-generated content for accuracy before publication.
- Ensuring property descriptions accurately reflect the property being marketed.
- Not publishing content that makes false, misleading, or unsubstantiated claims about a property's features, price, or legal status.
- Complying with the real estate industry codes of conduct in your state or territory (REINSW, REIV, REIWA, REIQ, REIWA, REISA, REIT, REINT, REANZ, etc.).
- Disclosing AI-generated content where required by your state's real estate regulations or professional body.
Propscribe does not publish content directly to listing portals. All output requires human review and publishing by the agent.
5. Real Estate Industry Standards
Propscribe is designed to assist, not replace, professional real estate agents. Our tools are built with the following Australian and NZ real estate standards in mind:
- REIA National Code of Conduct: AI-generated copy is designed for use by licensed agents who remain responsible for compliance.
- State-specific regulations: Our Auction Script tool generates state-law-aware content (e.g., vendor bid disclosures appropriate to NSW, VIC, QLD, WA, SA, TAS, ACT, NT and NZ) — however, agents must verify current legislative requirements in their jurisdiction.
- REA Group and Domain content guidelines: Output is formatted to meet typical listing portal character limits and style guidelines. Final compliance with portal-specific terms is the agent's responsibility.
6. Spam Act 2003 (Cth) & Unsolicited Electronic Messages Act 2007 (NZ)
Open Home Follow-Up Email content generated by Propscribe is intended for use with existing clients and contacts who have attended an open home — i.e., individuals who have a pre-existing business relationship with the agent.
You must not use Propscribe-generated emails to send unsolicited commercial electronic messages. You are responsible for maintaining your own opt-out and unsubscribe mechanisms as required by law.
7. GST
Propscribe AI Pty Ltd is registered for Australian GST. Subscription invoices issued to Australian customers include GST at the applicable rate. New Zealand customers are subject to NZ GST at 15% where applicable.
