Terms of Service

Please read these Terms of Service ("Terms") carefully before using Propscribe. By creating an account or using any part of the platform, you agree to be bound by these Terms. If you do not agree, do not use Propscribe.
1. The Service
Propscribe is an AI-powered real estate copywriting platform operated by Propscribe AI Pty Ltd (ABN to be confirmed), incorporated in New South Wales, Australia ("we", "us", "our").
The Service allows real estate professionals to generate property listing descriptions, social captions, open-home follow-up emails, vendor reports, listing presentations, and auction scripts using artificial intelligence.
2. Eligibility
You must be at least 18 years old and have the authority to enter into a legally binding agreement to use Propscribe. By accepting these Terms, you represent that you meet these requirements. The Service is intended for real estate professionals and is not a consumer product.
3. Account Registration
You must create an account to access the Service. You agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity under your account.
If you suspect unauthorised access to your account, notify us immediately at support@propscribe.ai.
4. Subscription Plans & Billing
- Free Trial: New accounts receive a 7-day free trial with up to 10 AI generations. No credit card is required.
- Paid Plans: After the trial, continued use requires a paid subscription (monthly or annual) as described on our Pricing page.
- Billing: Subscriptions are billed in advance via Stripe. All prices are in Australian Dollars (AUD) and exclude GST unless stated otherwise.
- Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled.
- Cancellation: You may cancel at any time via Settings → Billing. You retain access until the end of the current billing period; no partial refunds are issued.
- Refunds: Refunds are not provided for partially used subscription periods. If you experience a technical failure preventing use of the Service, contact us and we will assess on a case-by-case basis.
5. Acceptable Use
You agree not to use Propscribe to:
- Generate content that is false, misleading, or likely to deceive property buyers or vendors.
- Violate the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, or equivalent New Zealand consumer protection legislation.
- Infringe any third-party intellectual property rights.
- Attempt to reverse-engineer, scrape, or extract our AI models or proprietary systems.
- Share account credentials with other users (each user requires their own subscription).
- Generate spam, unsolicited communications, or bulk marketing content at scale.
- Use the Service for any unlawful purpose.
We reserve the right to suspend or terminate accounts that violate this section without notice or refund.
6. Intellectual Property
Your content: You retain ownership of all property data, notes, and information you input into Propscribe. You also own the AI-generated output created using your inputs, subject to the AI provider's terms.
Our platform: All software, interfaces, prompts, and technology underlying Propscribe are owned by Propscribe AI Pty Ltd and protected by copyright, trade secrets, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.
Feedback: If you provide feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without compensation to you.
7. AI-Generated Content — Important Disclaimer
Propscribe uses large language models to generate property copy. You acknowledge that:
- AI-generated content may contain inaccuracies, omissions, or stylistic imperfections.
- You are solely responsible for reviewing, verifying, and approving all generated content before publication. Published real estate descriptions must comply with the Australian Consumer Law, the Real Estate Institute code of conduct applicable in your state, and equivalent NZ legislation.
- Propscribe does not guarantee that generated content will comply with any particular legal requirement or real estate board guideline.
- We are not liable for any loss, claim, or regulatory action arising from your use of AI-generated content.
8. Limitation of Liability
To the maximum extent permitted by Australian law (including the Australian Consumer Law):
- The Service is provided "as is" without warranties of any kind, express or implied.
- Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amount paid by you in the 3 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
Nothing in these Terms excludes liability for death, personal injury, or fraud, or any consumer guarantees that cannot be excluded under the Australian Consumer Law.
9. Indemnification
You agree to indemnify and hold harmless Propscribe AI Pty Ltd, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party AI provider outages, or unforeseen technical issues may temporarily interrupt the Service. We will endeavour to notify users of planned downtime in advance.
11. Termination
Either party may terminate at any time. We may terminate your access immediately if you breach these Terms or if continued access poses legal, security, or reputational risk to Propscribe.
Upon termination, your right to use the Service ceases. You may export your data before terminating. We will delete your data as described in our Privacy Policy.
12. Governing Law & Disputes
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the courts of NSW, Australia.
New Zealand users also have rights under the NZ Consumer Guarantees Act 1993 and Fair Trading Act 1986, which these Terms do not limit.
13. Changes to These Terms
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or in-app notification. Continued use after the effective date constitutes acceptance.
